You may or may not be right. Depending on the law of the state where the suit was brought, any further claims coudld be barred under the doctrines of "res judicata" or collateral Estoppel. if the injunction was denied on procedural grounds, the plaintiff may still be alive, but if on substantive grounds it looks like the only avenue available to the plaintiffs would be an appeal. Caveat - I have not seen the actual court documents so what I am writing is based on the reports I have seen posted on this thread for the most part.
