This is just great. First tekboy gets in the way of my beauty sleep. Now Frank does it too. :)

I haven't thought it through to my satisfaction. Reviewing the recent information that has been brought to light a lot lately -- that the cable providers constitute only 10% of Gemstar's business -- gives me reason to think everything through again.

As you know, my thinking was that the cable operators coming to the table would indicate the start of the tornado insofar as the number of bowling pins are concerned. But I had also been thinking that their business was large enough that the sheer volume would increase sufficiently to result in a tornado. That 10% number changes my thinking about that.

And by the way, this exact thinking reminds me of the post you probably remember but couldn't find. In that post I wrote that there is likelihood that there will be a day in the future that we'll determine that Gemstar's tornado started well before the announcement of a major settlement. I compared situation with Qualcomm's, that the CDMA tornado started well in advance of the Ericsson announcement if you buy into my thinking. The implication was (is) that Gemstar's tornado could already have started. Good memory, Frank!

To answer your question, well, I'm not ready yet. It's late and I haven't had a chance to think it through.
