Conversely:

This award reflects Gemstar's unwavering commitment to defend its rights, including intellectual property rights, against those who breach or infringe."

The digital arb is up next while the big one in the courts concerning multiple IPR violations is a ways off. Henry has been stating for the past 6 months that an injunction was highly unlikely from an arb panel. He has not said that concerning the case in the courts. Anyway, I think this will all get settled before another decision is rendered.
