Steve, seems to me that SNDK would have done better if they issued a private placement of convertible preferred stock, thereby avoiding all regulatory hassles and also avoiding dilution of earnings on the common. This is a strategy used a couple of years ago by QUALCOMM. Given the pending agreement with Toshiba, I'd bet that some venture capitalists would be very happy to get a private placement of preferred.
