The alternative, ultimately, is kangaroo courts and the Star Chamber. If the police can get a conviction merely by arresting someone, if the prosecutors can get a conviction merely by indicting someone, what's to stop them from putting people in jail just because they are unpopular or inconvenient? The sheriff wants your wife, the prosecutor takes a bribe from a businessman who wants to get rid of a competitor, we don't think things like that can happen, but they used to, and can happen again. Knowing that they face tough opposition in court makes them stick with people they can prove are guilty of a real crime.
