Good points. But the insidiousness of the argument that Michael C. advances is that it is quite true that many, if not most, of the early settlers were Christians, and were given to thanking God and Jesus in their writings. From that, the argument goes, that this country was founded by Christians, and therefore it is a Christian nation. And that means, as far as I can see, a theocracy. The weakness of the argument is its beauty. One doesn't have to reason it through. No difficult thinking required. Simply pile on enough quotes from early Americans talking about believing in God, and then argue that this is a Christian nation, and non-Christians should just "deal with it."

I am glad that it will take more than this to change the law. I have great respect for Scalia, probably the most religious man on the Court. If there were nine Scalias on the Court, they still would not vote for theocracy.
