Incredible - Microsoft is it's own worst enemy. To wave that red flag in everyone's face. They know they are safe during this part of the election cycle since the political appointees that have to sign off on new initiatives are either looking for new jobs or have already left.

Our system of government, with it's periodical out with the old and in with the new, is the worst possible one imaginable - except for any of the other alternatives :-)

What Microsoft doesn't seem to realize is that, although the way Justice is organized precludes the kind of persistence that would be needed to carry a case like this to its conclusion, the class action civil litigation community does not labor under those restrictions. Sooner or later one of them is going to multiply $30 illegally derived additional profit per machine times 125 million machines per year times 10 years and it will be the tobacco companies all over again. But this time Justice has already done all of their discovery for them.

Remember that the standard in a civil case is lower than it is in a criminal case, and Justice seems to have won, or nearly won, many of its points in the criminal case.
