I'd love to see a citation/link to other suits by BD from those of you mentioning that info. I am no legal expert--I am no expert on much of anything for that matter--but I don't feel so worked up about this suit. Almost every company I own seems to have some sort of suit going on--either I pick some bad ones or its just normal life in the USA. Quidel says that they have licensed the patents for some applications from BD and the other applications supposedly don't rely on those patents. BD apparently disagrees but must get a court and a jury to agree likewise. More than likely the suit will settle and maybe BD will get more from that than they were obviously going to get from the negotiations. If QDEL really was using their technology and not paying for it, better to get that out of the way now rather than later. Nonetheless, I regret that regardless of the legal merits the company will still have to divert resources from elsewhere to their legal expenses. However, regarding the QDEL response re: no merit to suit--this language is boilerplate response by most companies sued so on its face it does not mean much. However, its likely that the company really believes it, too. Good luck QDEL, but its seems a bit early to say all is lost here, its no like it went from 20 to 2 (like Mercury or Centennial--not investments of mine, mind you) nor do I expect a collapse here.
