Not legally today by FCC standards on a commercial flight, but practically yes, subject to cell site availability and signal).

Absolutely. GSM but limited to 9.6 Kbps data service on GSM and 14.4 with CDMA currently. Perhaps faster with some wireless modems (as opposed to phones) but I'm not sure about that.
