Dipy: The Florida Appeals Court Decision is huge. It allows juries to asses punitive damages against a tobacco company--not just compensatory damages. There is no way that you can begin to control punitive damages or asses the risk to a company like Phillip Morris. You are going to have inflamed juries all over the country coming in with 8 or 9 figure puni awards, which will further increase the likelihood of more suits being filed, since what typically happens is that the puni portion of the award gets settled for 40% of what it was, because most states get the lion's share of the puni award.

Can you say Johns Manville? I mean talk about deep pockets. MO has some of the deepest pockets out there. And then we have that little issue of the big court deciding whether tobacco is a drub that should be regulated by the FDA.

It is very possible that in five years, smokes will be sold with severe restrictions in terms of content, quality, and availability.
And in the process, MO will still be paying huge bills for puni judgements.
