<respective share prices of AFFX and INCY suggest few major investors were waiting for the outcome of the appeal. >

Yes, 'the best' scenario appears to be implied in AFFX's stock price... I guess you could look at that as a positive, it would make me worry.

<It was my impression that the products sold by INCY which are similar to those sold by AFFX have been the subject of ongoing legal wrangling. >

INCY doesn't 'sell' chips like AFFX... they do inhouse experiments for clients... that said I believe they plan to.

<. In September, the US Patent Office issued a ruling favoring AFFX. >

Yes, this sent the matter to court rather than an instant win for INCY.

<Pleasant weekend to all! IMO AFFX is one helluva looking chimp with Gorilla potential. >

I hope you are right as 'Gorilla's' are few and far between... however other than AFFX's plan to have their 'chip system' become the system of choice I don't see that many similarities unless there is something special about their chip which makes it preferrable to potential competition. If anyone understands AFFX's patents and 'uniqueness' of their product which makes them a candidate, I'd love to get a dialogue started on the subject.
