The attorneys fees in AMPEX's suit would not be awarded by the jury but
rather by the court in a seperate hearing to be held at a latter date.
Typically the award of attorneys fees is permissable when provided for
in a contract between the parties OR when the suit makes a claim under
the provisions of a statute. Although I am not familiar with claims of
this sort (Patent) I feel confident that AMPEX's attorneys were able to
carve out a claim which would enable them to be awarded fees by the
defendant. Once again such an award is made by the court at a latter
hearing and not the jury.
