re: Lexar Media Patent Infringement Case

On September 17, 1999 court minutes indicate that a hearing date was set for SanDisk's motion for Partial Summary Judgement on 01/21/00.

At that time, SanDisk also moved for a preliminary injunction with "counsel to agree to a form of injuction." This was to be submitted to the court by 09/21/99.

On 09/20/99 Lexar "noticed" of a filing of bond pursuant to FRCP 65(c).

In reading through the docket items from 4/27/98 to 10/7/99 it is my general opinion that SanDisk been on the offensive trying to push the case through the system while Lexar has used counter measures to delay a final judgement. Of note, there was a settlement conference on 08/06/99 which ended without a final settlement. This conference was requested on 06/30/99 by the court magistrate.

Any legal eagles out there wishing to comment on the significance of these developments are more than welcome.
