Wayne - The real problem is the fact that Canada now has an entrenched Charter of Rights (Constitution Act, 1982) that puts these decisions into the hands of the non-elected supreme court judges and not into the hands of the democratically elected legislatures of the country. Everyone thought that the provincial premiers were way out of line when they argued against a Charter, but now look what we've got.
