Re: Patents. Prior to LU acquiring ASND, ASND licensed LU's ATM patents (and those from FORE if I remember). A quick search of the IBM Patent Database shows NN with very little in the way of patented intellectual property. LU, IBM, and FORE seem to own most patents related to ATM.

NN's defense is that the LU patents never should have been patents in the first place. Generally, this defense fails in front of jury of laymen who understand little of whats presented anyway.

Also, of note, CSCO, who has the most meager patent portfolio of any comapny its size I know of, recently bought IBM's networking related patents (a truly vast portfolio). CSCO has always maintained patent protection was relatively unimportant. I doubt that attitude will persist now that they are now in a slightly different position.

My prediction is NN will lose this case, and be forced to turn over 1% of revenue to LU, which is fairly standard licensing practice.
