John, there is only one way this case will go away and that is if it's settled. Otherwise, Judge Jackson is locked in to rendering a decision and, thereafter, it will be years before the appellate process runs its course.

I see cogent arguments on both sides, and I agree that everything that has occurred in the market subsequent to the commencement of the action has made the issues truly mind boggling.

At this point it may be best for us to focus less on culpability and more on what's best for the shareholders.

Some cases should be settled. This, IMHO, is one such case.
