Motorola Announces U.S. District Court Enjoins Qualcomm's 'Q' Phone
LIBERTYVILLE, Ill., April 11 /PRNewswire/ -- Motorola announced today that it has been granted a temporary restraining order against Qualcomm preventing further production, sales or marketing of its "Q" phone. The order was issued Thursday afternoon by the United States District Court for the Southern District of California in San Diego in response to Motorola's request.
Wolf Pavlok, senior vice president and general manager of Motorola's Pan American Cellular Subscriber Group, stated that Motorola is very pleased that the court carefully considered the merits of Motorola's claims and agreed with Motorola that Qualcomm should be prevented from manufacturing and marketing the "Q" phone, pending a further hearing before the court.
The court's order was based, in part, on a finding that Qualcomm's "Q" phone is "strikingly similar" to the patented design of Motorola's StarTAC(TM) cellular telephone. The order remains in effect until April 23, 1997, at which time the court will hold a hearing on motions for preliminary injunction filed by both Motorola and Qualcomm.
