There is a law using 144 stock as collateral I think but there are so many sleazy brokerage firms it is no problem for them to short. The SEC should also put a stop to boilerooms and payoffs to brokers to move customers into a stock and bribes to market makers to manipulate a stocks price and trading between two accounts to make it look like a stock has high volume and selling non registered stock and tout sheets that are crooked and and and many other tricks that cost penny stock investors millions every week too.
