Steven, MSFT would be able to recover damages due to the infringing mark. This could in theory be larger than the profits from the infringing product -- because MSFT's reputation could be harmed from the infringement more so than sales of this one product. The real kicker in a trademark suit is that MSFT could seek a court order to have the infringing product removed from commerce -- literally ripped off the shelves. That's worse than recovery of damages -- it's a death warrant.
