Patent cases are decided all over the world all the time. Sometimes the patents are found invalid, sometimes not.

The edata patent will be judged based on the prior art relevant to it. I am still waiting to see prior art better than the prior art considered by the examiner.

One more point, the standards and procedures used to determine validity are different in europe and the US. The decision in the European case was probably made by a specialty judge, who is tehnically trained. Here the decision will be made by a jury. Also, the patent is presumed valid. The defendants must prove it invalid by clear and convinving evidence. Who makes the decision, the burden and level of proof are extremely important (often the difference between winning and losing).
