W-CDMA folks if CDMA were deployed in Europe?

It is my thinking that QCOM will be the one doing the suing; going after the W-CDMA users for infringing on Q's patents rather than the other way around. Therefore, it is the W-CDMA folks who would get delayed if this came to pass. Whereas, CDMA can be employed without worry.

Am I off base here?
