Yes, your off base. QCOM is the one that will be suing. That isn't necessarily a good thing.

What I'm concern with is what operators will be thinking about all of this as far as the selection process is concern. Go with something that turns into a legal morass or go with the safe play. I always felt when Ericsson came with their ridiculous lawsuit, that they were only exercising FUD, which in turn weigh in on operators decision to deploy CDMA. Some probably opted to go with the safe bet, the one that would not cause customers aggravation that could be caused by outcomes of a lawsuit.
