A San Jose federal judge suggested Friday that he
will block two companies from selling clones of
Apple Computer Inc.'s popular iMac, concluding in
an unusual order that they would confuse consumers
and violate trademark laws with their products.

In a nine-page ruling that could have broader
implications for companies trying to replicate the
iMac's unique design, U.S. District Judge Jeremy
Fogel took the rare step of finding that a computer's
appearance is entitled to legal trade dress
protections.

As a result, Fogel stated in his order that he plans to issue a preliminary
injunction that will prevent Future Power Inc. and the Daewoo Group from
distributing their iMac look-alikes, the E-Power and the Daewoo. The only
holdup, according to the judge's order, is determining how much of a bond
Apple must post in the event the injunction is eventually invalidated. "
