MSFT is a monopoly by default-AAPL has never attempted to port to an INTC chip. DR had the head start back when and couldn't keep up. SUNW wants their version and their slow version of Java alone to be the lingua franca of the computer world. IBM just flat out quit.

In general, I agree. But it doesn't matter. Even if Microsoft was blameless in building its monopoly power what matters in this case is what they did with that power.

In other cases -- including the current Caldera suit -- plaintiffs will argue that Microsoft was not blameless in building the monopoly, but those are not significant issues for this case. In this case, the manner of creating the monopoly power is ignored. The case is focused only on what Microsoft did once it had developed its monopoly power.
