I agree MSFT could probably win on appeal, my concern (and everybody else's, I think) is the so-called "short term" damage. It's really not so short term. It's kept the stock down for a year at least (yes it has risen but not at its usual pace by any means), and could continue to do so, besides a selloff early next week. So Gates has to consider the shareholders and the stock. It's a bad position to be in. We have all been saying the trial has been priced in and everybody's been bored with the trial, and I believed that too but I think Monday won't be so pretty.
