Now now, don't go off the deep end. The MSFT evidence was not ignored. MSFT made a tactical legal decision to be very aggressive and obstructionist (and ANNOYING and misleading) in this case. If you saw any of Mr. Bill's testimony you know what I mean. This was a decision they had every right to make- but (imo) it backfired. I don't know who was in charge of their strategy- but we can say, at least in hindsight, that it was a mistake. The fact that the Judge was annoyed by MSFT's tactics does not disqualify him. Demeanor of the witnesses and personal impressions are ONE of the key things the tryer of fact must assess. If the Judge acted in a truly irrational or unreasonable manner his FOF would not stand. But I have to tell you that I don't think you will find anyone with an informed legal opinion who well tell you the Judge was irrational or unreasonable.
