See my response #32388. Judge Jackson is regarded as a conservative, and he was also appointed by Reagan. You are suggesting prejudice on the part of Jackson, based on the notion that he was angry over an earlier appellate ruling on a related matter. However, as many have pointed out, an appellate court rarely will dispute findings of fact. And these findings provide the basis for actual DAMAGES. That is one aspect of the potential outcome I believe has been missing from much of this discussion. There are real damages here, and the companies who were damaged, including IBM, will have a field day with claims.
