Two things have to happen. First, Intel has to have a legitimate claim that MMX is their (Intel's) trademark.

Normally, the use and claim thereof can establish ownership of a trademark - which Intel is doing - and they are registering it with the Patent & Trademark office. The registered trademark, MMX, has not yet been granted.

There is a court date set for late in April, I think, that may address the issue of the term MMX - is it indeed "trademarkable". I won't go into the arguments, since only the courts/patent office can decide this.

If and when Intel is granted trademark status, I believe AMD can print up a bunch of stick-on labels with the Intel MMX monicker, and send them to their distributors and OEM's to attach to existing K6 packages.

This should not be a big financial deal for AMD. However, this is merely my assessment of the issue.
