I agree that this does solve some of VIA's problems. I think Ken Potashner of SIII deserves the praise for pulling this off. However, for some reason S3 stock price does not represent this belief - yet.

IMHO, this is too early to call. VIA may circumvent some of the issues with the SIII deal but the game is far from over. Lawsuits, regardless of the final outcome (which no one knows for sure at this point) have a pretty clear chilling effect - especially when it comes from an entity like Intel.
