You make no sense at all. AMD does not take INTC's code and put it into their chips. They write their own code in a clean room environment that ends up doing the same functions as INTC's. This makes both of their chips Proprietary, not public domain.

The same can be said about the O/S. If someone else wants to write another O/S that does the same functions as MSFT's, they are free to do so as long as they write all of their own code. They should not be allowed to use the code written by MSFT!

As you said, you could buy a pentium chip and build your own PC with any components you want. This includes the O/S. You can buy Windows, or Solaris, or OS2, or use Linux for Free! You will get what you pay for!

Just because one O/S out of many is free does not mean that all O/S's should be free! MSFT has spent Millions of dollars developing this O/S. Their whole company was built around this O.S. Why should they give it away for free? It makes sense to no one but you.
