You state the premise that the O/S should be public domain.
This is not the way it works and never has.

The languages such as C or C++ or whatever are for all practical purposes public domain and standards are governed by the CERN. However, companies can package them and add tools for ease of use and sell their versions if they so choose.

The O/S is the unique product of the company that created it
using a computer language. Your comments regarding O/S being public domain are totally in contravention with the way things have been done in computing since the 1950's.

You can make a weak argument about public domain and languages, you have no leg to stand on reference O/S and public domain unless someone chooses that route as with Linux.
