This is a hollow threat, MSFT would welcome the opportunity to go into state court and argue their case in front of real American's.

The states can barely win a case against tobacco, probably the most vilified industry in latter day American history. I would love to see how they would attempt to portray MSFT as hurting consumers and not end up making themselves look more biased and vindictive than they already are.
