While I am far from an expert, I believe there is a provision in patent law called "leches" (sp?) that says you can't collect damages if you knowingly allow someone to violate your patent for the purpose of increasing collectable damages.

So, if they know their patents are being violated Gmst must notify otherwise the courts can restrict damage awards.
