As I recall, vendors have to certify the modem that they will be
shipping. If the hardware changes or they come out with newer
model, the model has to be run through certification. I'm not sure
exactly how picky they are about SW changes. I think once your modem
is accepted, you are on the "inside" as Pete Fenner mentioned in
one of the CC's, and you can update software. I would think though
that major SW updates would require re-certification. Someone would
need to correct me on this if I'm amiss.

I can't speak for TERN's DOCSIS modem as to whether they'll ship
that one or not. As it is an OEM'd version, they at least
have something to sell.
