There is more here than meets the eye in my opinion. The timing of this suit seems to be a deliberate attempt to push Qdel's price down at a time when (I believe) they are on the verge of reporting excellent earnings. Smells kinda fishy on BD's part to me.
It is my understanding that Qdel had (and still has) an opinion from its patent counsel that Qdel was not "infringing" on BD's patent in its various tests. Even if Qdel's patent counsel is wrong (a point which I am certainly not prepared to concede), it seems to me that Qdel's reliance on this opinion would definitely establish that Qdel did not in any way act "wilfully" as the suit alleges. Hopefully, this should eliminate any chance of treble damages for "willfully" infringing on BD's patent (presuming there is any merit to BD's suit at all). Although it may take a few weeks or more likely months, don't be surprised to see this suit settled shortly. We all are experiencing the worst possible combination at the present-bad news about our company in a bad market. Uncertainty is what is hurting Qdel right now- there is still nothing but good news ahead on all other fronts (and hopefully on the BD suit as well). Be patient, hang in there, and don't lose your focus, everyone.
