JFD, It appears that the favorable opinion of MSFT in gallop polls is very important. It is also sending a subtle message to the State AGs that to stretch this case out for their political gains is a flawed strategy. After all it is not big tobacco.

This point might help speed up a settlement if they care about re-election. Rival candidates should be using this case as part of their campaign next year. I bet there would be good success if they pursue such a strategy against the current bunch.
If there is a settlement, the STATE AGs go out as clear winners and can say that they have helped innovation.
If they don't settle, they will have to face it as a campaign issue. Given the public still have a positive opinion of MSFT, they will have a hard time defending their positions in the election campaign---the same way MSFT had trouble defending its case in the courts.

As for the possibility of lawsuits by the states for damages---that would be an excercise in futulity given they won't have Judge Jackson to run to. The juries will be made up of those individuals that have a favorable opinion of the company and it will hard to convince them that consumers have been hurt.

The key here is symphathy. MSFT should continue to defend itself in the public as a company that is working for consumers to get the best features at the lowest price. More and more people will feel sympathetic towards the company especially since there was such a lop sided fact finding.

OK, i am going to start buying back some shares tomorrow. I was planning on waiting until next week but tomorrow may be a good start; a way to average my cost. Still not willing to make it one of my bigger holdings at least for a few weeks.
