In fact the system in Germany works in the opposite way. Big companies are suing smaller companies to death (e.g. over patent infringements, or they just ignore existing patents and involve smaller companies into multi year long lawsuits until their financial reserves are eaten up.
Probably this is also the idea of the DaimlerChrysler lawsuit.

That's our system. It sucks in the same way only in the opposite direction. However, in this case I like it.
