If Microsoft is forced to release Windows' source code, could they comply with this demand and release only the instructions, and not the comments? I imagine that this code would be difficult to understand in the best of circumstances, but without the 'signposts' it would be an unfathomable maze of no use to anyone. Could they remove all 'extra' white space and formatting too? Even the most trivial program would be rendered unintelligible using this 'style', but if the thing compiles (assembles too), Microsoft has met the letter, if not the spirit, of the order.

Perhaps Microsoft could use proprietary editing tools so they, and they alone, can makes sense of their files. Since these tools are NOT part of Windows, they wouldn't need be released.

I hope people with greater legal knowledge than me will provide a more informed opinion on this matter.
