You mention double-speak, but fail to recognize that it comes from both sides in a case like this.

Consider, for instance, Microsoft's superb PR tack in response to the FOF. Whenever anyone from Microsoft talks about the case now, he (always "he") will use the phrase "Freedom to innovate." It's an amazingly good phrase to use in this case both because it both elucidates and obfuscates.
Either side could have used that phrase as a PR shortcut for what they're attempting to do, but Microsoft is much better at that game.
