Ken.. this can all get very confusing, in a flash. One needs to be attuned to the actual regs on a 24 hour basis... the ones that have been passed, that is. AND clairvoyant, at the same time. I think I'll attempt to recruit Tim (WTC) to sort this out, since he always seems to be on top of these matters like few others on these boards.

Thinking back, in August the FCC ruled that the BOCs could create their own entities and compete with the startups using their own separate facilities. I'm not sure how many takers there were, though. Now you're referring to a future condition whereby unbundled network elements (specifically copper loops) will be leased at the wholesale level to CLECs, as though it was a done deal. I don't know that it actually is, yet, or if it will be. Please point to some reliable reference on this. When is this ruling supposed to take place by?

I also find it somewhat edifying that the larger LECs (GTE in this case, but they are grouped with the BOCs, so the same might be in store for them too?) have now taken to "partnering" with their would be competitors. Hard to believe, from the perspective of an historical framework.

Do you suppose they are doing this to preempt being forced into the situation where they "must" supply the loops to their adversaries?
