FWIW, here is a question and answer lifted from Biotech Rumor Mill:

"Q: Can anyone advise as to the merit of the patent infringement suit B-D has against Quidel? Is this just harrassment on B-D's part, or do they have a case?"

"A: Presume it relates to the patent held by BD for lateral flow by particles ie colloidal gold strip tests which Quidel make. There are 2 significant patent suites for strip tests, one lot held by BD, the other by Unipath. Last year BD & Unipath agreed to recognise the patents each company held and go chasing after infringers. Quidel sales must have reached a point above the threshold level and triggered a response. Believe that Quidel haven't licensed the patents yet, now may be the time that they do so..."
