I was wrong, John. I said so. I apologized. My point in that message was invalid because of the mistake.

The comments of South Carolina's AG can be taken on their face without the other considerations that I mistakenly said should be considered. The AG, Charlie Condon, said he pulled out of the suit because he believed that AOL's purchase of Netscape showed that competition had not been restrained by Microsoft.

"I can no longer justify our continued involvement or the expenditure of state resources on a trial that has been made moot by the actions of the competitive marketplace," the Republican attorney general said in a statement.

He made the decision before depositions had been taken concerning that issue.

Condon denied that a contribution of $20,000 by Microsoft to Republican campaigns in SC had had anything to do with his decision.
