DLO: This poor excuse for a judge is only seeking an out of court settlement because:
1. It will be overturned
2. Even if by some miscarriage of justice it is not, the remedies are not only confiscatory (right to private property) but totally unworkable without constant supervision. Those remedies sought by DOJ will result in higher prices and the fragmentation of the de facto standard ala Unix. This fragmentation will serve to benefit only those competitors who saved their own money by provoking DOJ to bring this case at taxpayers expense (many of whom are MSFT shareholders). It will harm not only the consumer but the third party developer and box-maker as well.
And even those who think they have gained a short term benefit will be the biggestt losers in the long run as they become hooked on their own petard.

The only thing that can get Jackson's hoof out of his mouth is a settlement out of his court; the likelihood of which was greatly diminished by his arbitrary and inequitable findings of fact ruling.

P.S. Perhaps MSFT should have asked the government what part they played in perpetuating this monopoly by supporting MSFT through gargantuan purchases of MSFT products. How many Macs does the government own? How do they justify this abuse of their fiduciary trust regarding the spending of taxpayer's $ in supporting this illegal monopoly especially when the product is so inferior?
