Corel Responds To DigArts Software Statement
OTTAWA, ONTARIO--In response to a press release issued today by DigArts Software, Corel Corporation (NASDAQ: CORL, TSE: COR) confirms that a lawsuit initiated against Corel by DigArts, and its owner Dennis Berkla, regarding Corel's use of DigArts' digitalartwork, has concluded.
In finding that Corel was liable for a breach of confidence and for breaching the terms of a non-disclosure agreement between the parties, a federal jury awarded the plaintiffs damages in the amount of US $23,500. In addition, Corel stipulated that the minor copyright infringement relating to a limited number of beta copies of software would result in damages of US $9,100.
"While we are disappointed with the jury's finding, we are pleasedthat the jury recognized the limited monetary impact resulting from these actions. As a result, this final award will have no significant financial impact on Corel," stated Michael O'Reilly, executive vice president finance and chief financial officer of Corel Corporation.
Although the jury also found the plaintiffs eligible for an award of punitive damages, the trial judge had previously ruled that punitive damages could not be awarded in a case of this nature. |
