Microsoft's main firm in this case is very well respected, I am familiar with them. As for the lawyers being incompetent, it beats me. Their strategy is most likely more complex than something that can be concocted on a discussion board, but I think the overall grasp of the current technology landscape escapes many a legal pundit, judges and lawyes alike.
