The remote location MUST make the product, i.e. create a program one adisk. Of course the disk exists before the sale, but the sold item (disk with content) isn't created until the program is downloaded.

I think it is a stretch to say that a mailed item infringes. There is no such thing as partial infringement.

But, if most net sales are covered (when the product is downloaded) then we are still looking at a huge royalty base.

Does anyone know if MSFT was sued. They must have downloaded a huge number of programs, including explorer. The fact that they give them away still doesn't excuse them from infringement. They would still have to pay a royalty.
