i think you're right but i'm no cpa or tax lawyer..they are still different stocks..

i actually have gain in cscc so i'll hold it because it's trading at discount to .7 merger exchange so, as completion gets closer, it will pick up that discount of about $2. in fact, i might buy more.

but for you it might make sense if you're willing to pay that arbitrage premium.
