My interpretation. Qdel has a test series that will do well in the market. BD wants a part of that series. Since it can't negotiate a leverage....it is using the court due to "lost patience."

I wouldn't lose focus. A negotiated settlement is in the best interest of both parties. A likely settlement is after all, what the court will do in attempting to bring both partners back together.

If Qdel attorney's are telling mgt that they are in a good position, which it sounds like is the case....why worry so much about what is now likely factored into the stock price? I feel a negotiated settlement is also highly likely....since Qdel is negotiating....onus is on BD. Court will just level the playing field and probably is in Qdel's favor. If they win....BD pays...so at this point, things look at worst, factored into the stock.

Good earnings are likely and may offset some of the nervousness. Just IMHO.
