Gemstar's patents are just as broad and some
are just as non-specific as the one I read
about a short while ago (WSJ, SJMN, SFC) relating to
e-commerce. There, the inventor had received a
patent in electronic transfer of payment
information using digital communication
for the purpose of purchasing goods or services.

Patents are just that, until someone decides to
challenge them. A lot of patents being granted today
would have seemed unreasonable only a short while
ago; it is not every day that an Einstein works as
a clerk in them patent departments.

Also, I don't find the long-term licensing by Microsoft
and AT&T to be the decisive factor. The logic appears
circular. They also may have left themselves some wiggle
room.

I am yet not convinced that Gemstar has a lock on any
form of communicating the CDTL data to the VCR. What if
I were able to talk to my VCR ?
