I think Judge Jackson is in over his head and he knows it. Due to his bias against MSFT he signed off on the DOJ position for all practical purposes. After the FOF he realized his error so he tries to bring someone else in that is legitimate to try and get a settlement out of court. It will not happen. His FOF creates a divide. The states want more and the DOJ may want less. The two sides will not come to agreement. MSFT has very little to lose by going forward with appeals when the time is right.

My position from the 19th remains the same:
...I don't think the mediation will work. The states and DOJ will never reach a unified position. Some of the 19 states will bring their own cases. It makes no sense to negotiate something that doesn't carry the rule of law.
